Boy you’d think by the hysteria over at Focus on the Bunghole that DOMA was about to be overturned by the Obama Department of Justice. The knickers are in a twist over the cases filed against the constitutionality of DOMA by Massachusetts Attorney General Martha Coakley and Gay and Lesbian Advocates and Defenders (GLAD). When the judge ruled it ungonstitutional, the right erupted and put on their stylish tin foil hats. (Right Wing Watch):
Tom Minnery, Vice President of Government and Public Policy at CitizenLink (formerly Focus on the Family Action), is insisting that House Republicans investigate the Justice Department over their handling of the Defense of Marriage Act, or DOMA, in order to fulfill the desires of the GOP’s Religious Right supporters.Infuriated by the judge’s ruling, Religious Right activists were so assured of DOMA’s constitutionality that they maintained that the Justice Department must have intentionally mishandled the cases and purposefully lost. Tom McClusky of the Family Research Council said that “in part, this decision results from the deliberately weak legal defense of DOMA that was mounted on behalf of the government by the Obama administration,” and Mat Staver of Liberty Counsel and David Barton of WallBuilders recently discussed why they believe the Justice Department “threw the case.”
Minnery’s top-class Reynolds Wrap headwear has resulted in his declaration that the House Republicans were wusses the last time they were in control and that the social conservatives must have hearings to investigate the allegedly deeply pro-homosexual DOJ.
Will there be comprehensive hearings by House oversight committees on the unwillingness of the Justice Department to thoroughly defend, as the Constitution requires, legal challenges to federal laws? I have in mind the Defense of Marriage Act. The Justice Department has failed to provide an adequate defense against lawsuits seeking to tear away this law.

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws(except for the homos, of course, they don’t count).

There is no sound constitutional argument for the deprivation and discrimination of a group of people. The only ones purporting this is the “I’ll tell my congregation to vote for you and host polling stations if you institute this dogmatic social regulation on the country” group.
What needs to happen is the church and politicians need to be called out for the sleazeballs that they are. I mean expose them for the RAW and openly blatant connections they have.
Then refer to the constitution that the “Congress shall make no law respecting an establishment of religion.”
It is not that far of a stretch to make the connection. If they argue “it’s states rights” then just point out that the STATES MUST FOLLOW THE US CONSTITUTION. i.e. The states can not make a law or constitutional amendment in violation of the US Constitution.
They are deliberately crafting language that is a direct result of biblical influence without reciting the verses.
It’s all about motive in the courts anyways. I’m sure a competent lawyer can make this case.

at about 1:31 they talk about DADT and DOMA. The POTUS need not “defend” DADT or DOMA. They say he can tell the SCOTUS that they are appealing BUT they believe that DOMA is unconstitutional and offer an Amicus curiae attorney to argue for DOMA while the DOJ argues it’s unconstitutionality.
So if our POTUS is so freeking smart, why didn’t he think of this?

Heaven forbid the judicial system acts to dispense justice! They’re supposed to be like the old days — sentence them guilty, send them to prison, and throw away the key, and beat them until they’re dead (unless an angry mob happens to do their job for them!).

The brief the DOJ submitted on DOMA was, as I am sure you all recall, something that would have done Peter LaBarbera proud in terms of being a vile misrepresentation.
Why would they want to investigate someone who compares us to pedophiles? Shouldn’t they be cheering him on?
