I heard NOM playing Mellencamp’s “Pink Houses” during their rally in Madison, WI.A contact with John Mellencamp’s publicist confirmed my suspicion. Not only had NOM not received permission to use the recording, but John Mellencamp does not want his music associated with NOM. In fact, John Mellencamp stands solidly with us – on the side of equal rights. Thank you, Mr. Mellencamp, for your support!
…Of course, this is just more of the same from the National Organization for Marriage. They’ve repeatedly used the music of artists who are not interested in being associated with NOM’s discriminatory message. They consistently lie about being oppressed, trying to take the role of victim, blaming the very people they’re oppressing. They’ve even attempted to co-opt the message of Dr. Martin Luther King, Jr., claiming that their perverted idea of civil rights somehow makes them his “natural heirs.”
So Brian Brown, I have a few questions for you: What other music have you used without permission? How many people do we need to contact for public disclaimers before you realize that these artists whose music you exploit want no part of your bigoted message?

Fuck letters are the first stepYou have to tell them, “You are infringing on my copyright so fuck off” before you can sue them.
.The letter just asks them to use someone else’s music, yes there is an implied threat and all that, but overall, it’s a pretty warm and fuzzy letter.
IMHO, a cease and desist followed a day later with a few pieces of paper delivered by a cop.
NOM has done this with other artists and exposed themselves by doing so.
If you could get even 5 or 10 of these artists to send settlement offers of 10k each and nom accepted, you’d be able to take that money out of nom’s bank accounts. I think taking 50-100k of their money would be a pretty decent achievement, they could even donate that to glbt / pro marriage equality causes.
If they refuse, bleed them and their supporters to death with copyright suits. NOM likely has a deal for cheap / free representation, but you can still make it a pain in the ass for them and all the while, you’re bleeding their supporters dry. Overall positive.
.And I don’t think 10k is an unreasonable settlement offer. People downloading movies and CD are being sent offers of about 3-4k.
