OMG. What IS going on in Latin America! Just a couple of hours ago, the Supreme Court in Costa Rica ruled that a referendum scheduled for December 1st which would have banned marriage rights for same-sex couples was unconstitutional.The article does not give the vote total but says that the majority determined that the issue of marriage rights was a judicial issue and not an electoral issue and that the rights of minorities should never be subjected to a referendum process where they might be subjected to the wishes of a majority.

Wonderful, too bad the majority of U.S. Citizen’s are religious bigots and can’t see past their own pews to understand the 14th Amendment to our Constitution.

What has happened to the USthat we have fallen so far behind in human rights issues? It is so incredibly sad! Maybe we’ll get our collective act together sometime soon. I hope so, for all our sakes, not just those of us who are LGBT.

Sorry, my question was way vagueWhat I guess I meant was, if the Supreme Court agrees that marriage is a right that shouldn’t be voted on, then how long could it be before marriage equality comes to Costa Rica? The Court says it’s a judicial issue and not an electoral one, so that sounds – at least to me – like the Court would be on our side if it came before the Court. Maybe I’m just reading too far into it.

For example, until Andres told us today about this ruling, I didn’t even know there was a referendum and that the court was considering the question of its constitutionality. FIRST OF ALL IT DECIDED THAT THIS IS NOT AN ISSUE TO BE DECIDED WITH ELECTIONS, THAT IT WAS A MISTAKE BY THE NATIONAL ELECTION COM´MITTEE TO HAVE ACCEPTED THE REQUEST FOR THE REFERENDUM. THE COUT SAID THAT IT IS A LEGISLATAVE ISSUE AND IN A WAY ORDERD OUR CONGRESS TO DRAFT A LAW ON THIS ISSUE. It’s about whatever we think is pertinent and important, and the Mexican Supreme’s decision is very important.
It means that der papenfuehrers attempt at a preemptive strike is going down in flames. Costa Rica, Mexico, Argentina, Spain and Portugal are all ostensibly countries dominated by the catholic cult. Spain and Portugal were the originators and last holdouts of the inquisition and both were dominated until recently by catholic fascists.
In three of them, Argentina, Spain and Portugal, der papenfuehrer campaigned hard against same sex marriage and all three countries kicked him in the ass. (Mexico forbids cult interference.)
One thing it means is that the influence of the roman cult has been seriously weakened in Latin America.
Cuban leader Raul Castro is a long time hard line Stalinist and phobe so progress there is problematic in spite of the revolutionary traditions of the Cuban people. Same-sex civil unions, a second class form of same sex partnering are “legal in Uruguay (2008), Ecuador (2008), Colombia (2009), Brazil (since 2004), and in a few… Venezuelan states.” Uruguay is on the road to transforming second class civil unions into first class civil marriages.
