Today in a simple two page ruling of appointed Gov. Brewer’s request for an expedited hearing on this week’s lower court gutting of SB 1070, the Ninth Circuit Court of Appeals ruled, “To the extent that appellants seek to expedite the appeal beyond the provisions of Ninth Circuit Rule 3-3(b), appellants’ motion is denied.” The Court further ordered, “The Clerk shall calendar this case during the week of November 1, 2010 in San Francisco, California.”In what can only be seen as yet another political maneuver appointed Gov. Jan Brewer today reacted to the Appellate Court’s decision by threatening a special session to “fix” SB 1070.
This tactic is yet another political ploy. SB 1070 created a smoke screen for the accidental governor masking Brewer’s complete void of any vision for creating jobs, improving tourism and housing markets and upgrading Arizona’s education system.
Brewer is riding a slippery slope on one ski – SB 1070. She has failed to notice that the ground is softening under her and that her “single issue” agenda is not going to carry her through the General Election.

Powerful protest going on nowI’ve been following the powerful on-going protests in Arizona through the Facebook group Standing on the Side of Love. People of faith and others are demonstrating and some being arrested by the notorious Arpaio. Very moving.

Quite literally, among the provisions of the bill are suspicion of having committed a crime that would allow someone to be deported.
As a resident of Dear Joe’s county, I can say that his deputies, despite some decent training efforts (by cis/het folks) on the subject of LGBT lives, have a strong tendency to be suspect of LGBT persons solely on the basis of their being LGBT and therefore subject to warrantless arrest on those grounds.
Also, due to the nature of the requirements for ID, if a person has a different appearance than is indicated to the officer on their ID, some officers will (and have) used that as cause to house the individual pending their status.
LGBT Latin@ and Hispanic individuals, as well as Native Americans, here in Phoenix have long been subject to harrassment and attacks fro having the double tap of being ethnic and LGBT here in Phoenix.
My roommate is a refugee, Trans, and does not have a green card (well, yet) — she is here “legally”, but can be stopped and then taken into custody and detained while they figure out the legal status she has in a database which does not exist using a system which is not funded.
For a broken tail light, or perhaps a cracked windshield, or maybe even a speeding ticket (all offenses which normally result in just a ticket, not detainment).
This is our issue just as much as anyone else’s. Which is why I was out there myself Thursday Morning.
And, interestingly enough, because I’m white enough to get by, I was passed over by the deputies. Despite my not once speaking English in their presence.
