We were in the courtroom as Lt. Dan Choi and Captain Jim Pietrangelo, jailed for chaining themselves to the fence at the White House because of inaction on repeal of DADT, and it was a dramatic and moving appearance. Many of the ENDA 8, and and other supporters were also present, including Alex Nicholson of Servicemembers United, a nonprofit organization tasked with advocacy and activism on DADT.
Jim Pietrangelo was brought in first, in handcuffs and heavy leg shackles, and was told of his options after being charged with Failure to Obey A Lawful Order by a Police Officer. One cannot be jailed for this offense, but he could:
* go to trial
* pay a $100-$1000 fine that would go to a special victims fund
* pay a $100 fine with the case closed to avoid a trial with no admission of guilt.
The judge was surprised when Pietrangelo declared “not guilty” and wanted to proceed with a trial. What this means is that he will face a different judge in a different court and has to retain his own attorney. He and his attorney must appear in court on April 26.
Pietrangelo was released and left the courtroom.
Dan Choi was led in, looking stoic and resolute as he stood at the podium. He was charged with the same violation as Pietrangelo and when the judge read the same options to him and asked for Choi’s response, he said:
“I’m not ashamed, I’m not finished. Not guilty.”
As he was released, the heavy shackles crashed to the floor much louder than it had when Pietrangelo’s were unlocked, reverberating noticeably.
There were hugs and tears all around for both Choi and Pietrangelo as they left the courtroom. It was an amazing moment for the movement, but aside from Alex Nicholson, it should be noted that none of our advocacy organizations sent a representative to attend this historic event in civil rights activism.
As he walked to the lobby to exit, I asked Dan to share his impressions about his time locked up for his activism. I thought I was going to have some great footage to show you but it was at time that the surly D.C. Superior Court security thugs asked roared for a Newsweek reporter, Joe Sudbay and I to give them our cameras and to delete the footage.
Now I have to tell you that when we first went into the court building, you have to go through screening. I put my bag, which had a ton of gear, a laptop, cell phone and two cameras in it on the belt, and it went through and I was allowed to take it in.
There was no sign on display saying no photography or recording in the building.
So what would you assume? The security didn’t ask to hold the camera prior to going in after it was screened, and there’s no sign saying you can’t use it.
They reviewed each camera (and my cell phone!) and told me to delete and footage or photos, then asked me for my name, address and phone number, ostensibly to put us on some sort of watch list, I suppose, but the clear message was intimidation. Joe Sudbay’s account, just so you don’t think I’m blowing this out of proportion:
As we left the court house, several of us started filming Dan. Big mistake. The court house doesn’t allow filming in the hallways. Now, there’s no sign that says anything about it — and we were allowed to bring our cameras in. But, the marshals sprang into action. And, I have to add, Marshall Gambel was pretty obnoxious about it. As if we all knew that the Executive Judge had to approve it. Whatever. I had to delete 24 seconds of video. But, as you can see below, I got great video outside of the court. Dan had a message for our leaders:
Note: a law student, one of the ENDA 8 said she has recorded time and again in this courthouse, in fact in a courtroom without an issue, so it appears that only SOME people are not allowed to film in the lobby.
After that drama, we did get to film outside and I asked for Dan and Jim to comment. It was riveting. He challenged the President, Congress and LGBT leadership.

Colonel Karremans (Dutch) files his third request for air support with the United Nations. The Serbs shell Dutch positions. UN Commander General Janvier rejects the request for Air Support. Serbs are on the hillside over the town center. Karremans again makes a request for Air Support.
General Janvier finally agrees to Air Support. The Serb attacks stop. Colonel Janvier postpones the air strikes until morning. Karremans tells the town leaders that 50 NATO planes will bomb Serbs at 6 a.m. the next morning.
July 11, 1995
9:00 a.m. Colonel Karremans is told that his request for close air support was submitted on the wrong form. He must re-submit the request.
10:30 a.m. The air support request reaches General Janvier. Airborne since 6 a.m., the NATO planes are out of fuel and must return to base in Italy.

Thing I was picturing was the post-WWII trials, the German and Japanese defendants with blank uniforms.

Still, I’m more angry with HRC for going along with it in the first place, and once again showing that they care more about kissing straight people’s ass than actually advocating for the community.

As for the controversy, Gawker had it right-HRC is useless. And it looks like Griffin is as well. Kudos to Lt. Choi for showing some REAL courage.
I don’t understand…I don’t understand the positioning here. Don’t get me wrong, I understand the protes–although I don’t understand why they didn’t do this sooner or later (meaning after the whole healthcare soap opera) because they could have gotten more coverage.
But to plead not guilty seems strange. It is an open and shut case. The court proceeding will probably last no more than an hour with the officer saying yes I told him to leave the premises and he didn’t. They will not get much more air time over this by extending it this way and could very well end up in jail and with a higher fine if they run into a judge who thinks they are wasting the courts time.
I agree, we should spend less time tryingto figure out which lgbt people and groups are the enemy, and more time working towards equality under the law. Lord knows we don’t have enough friends, we don’t need be dividing and conquering ourselves by breaking up into enemy camps.

Not shooting down allies..And frankly, after hearing this I’m not too sure about Kathy. My gut always told me that she really IS an ally,but wasn’t above using that to further her career. Kinda like Lucy Lawless(no offense meant to Xena fans out there). There’s nothing wrong with that, but if this Gawker bit is true, you’ve got to wonder about that. Remember, don’t trust Hollywood people. They’re actors (or directors or writers, etc.)they know how to manipulate people. Not everyone in Hollywood has our interest at heart. Most do-I’d say a good 90% of people in the industry are LGBT friendly. However-Hollywood is not liberal at all-it’s actually very conservative and afraid of losing money from the yahoos if they are considered “too” LGBT friendly. I’d say it’s a reason for all the negative portrayals of gay men and lesbians in the movie industry. And I oughta know-I live in the LA CA area. Hollywood is not the greatest place in the world to be gay or lesbian.

I can quote verbatim because I took notes and wrote a report on this for work.
The Dutch lost five of their observations posts in the southern sector of the “safe” enclave in the days prior to the massacre, some forces withdrew, some were captured by the Serbs. This ws done in accordance with Directive 7, issued by then President Karadzic. To accomplish this, he unleashed Drina Corps, 2,000 strong, an armoured corps with tanks, mortars and machine guns. to overwhelm the 400 Dutch peacekeepers.
French General Morillon had visited the enclave and proised the Bosnians that the UN force would not abandon them.
Lt Col Karramens was not to fire upon the Serbs, made repeated requests for support, and there was one air attack with but two British jets upon the Drina Corps armor advancing on the enclave.
The the weather deteriorated.
Then the Bosnian Commander upped the anty by threatening to kill Dutch and French prisoners that the Serbs held, in contravention of current international law on hostages(See ICT-Y indictments of Kradzic and Mladic)
“Then the Serbs took the enclave.
And a nightmare was visited upon humanity”(ICT-Y, Hennessey, Mladic Indictment, prosecution statement opening motion hearing)
The General that Sheehan cited as his source does not exist. If he meant General van den Breemen, that august individual called Sheehan’s testimony Dutch Minister of Defense , member of parliament at the time of the 1995 incident, stated that Sheehan’s statement was”disgraceful…unworthy of anyone in the military” and that Sheehans reamrks were “total nonsense”.
General Sheehan’s LIES have damaged our relationship with our Dutch allies and the Dutch government. The responsible Dutch commander, the Dutch Prime Minister, and the Dutch Miniter of Defense have not saud that Sheehan was mistaken; they have said that he is a disgrace and that he is lying.
This event has been investigated for 13 years now. If gay troops had ben an issue, the rabidly homophobic Orthodox Christian Serbs would have been the first to trupmet the charge. They didn’t.
General Sheehan, unworthy to be called a soldier, you lied.
