Update (from Autumn): Below the fold: The Courage Campaign’s statement on the “Explosive Courtroom Documents” discussed in the courthouse today.
Apparently, similar statements to the rally’s statements were presented in documents to the court today.
UPDATE 2: Below the fold, points from testimony of Gary M. Segura, Ph.D., Professor of American Politics in the Department of Political Science at Stanford University.
Just in from Yusef Robb of the American Foundation for Equal Rights — key quotes from the Prop 8 campaign’s simulcast rally that was shown in court today. It’s priceless. Man-on-horse, pedophilia and incest hysteria claims are made about marriage equality.
I’m glad all of this is going on the record — again, the basic concept of CONSENT is nowhere to be found among these people.
“Then pedophiles would have to be allowed to marry 6-7-8 year olds. The man from Massachusetts who petitioned to marry his horse after marriage was instituted in Massachusetts. He’d have to be allowed to do so. Mothers and sons, sisters and brothers, any, any combination would have to be allowed.”“Second of all, the polygamists are waiting in the wings because if a man can marry a man and a woman can marry a woman based on the fact that you have the right to marry whoever you want to marry, then the polygamists are going to use that exact same argument and they’re probably going to win.”
“We are seeing the people of Massachusetts being desensitized day by day concerning homosexuality and becoming more and more adjusted to the idea of homosexual marriage being the law of the land and the homosexual agenda becoming more and more of a powerful element in the life of our society.”
“I think a helpful way to think about this is to compare it to 9/11 cuz a lot of us are asking-How does this directly affect us? Well I wasn’t directly affected by 9/11 and my guess is most of you weren’t either in the sense I didn’t know somebody who crashed the plane in the building. I didn’t know somebody who was in the building. But after 9/11 the world was a fundamentally different place and that has affected me. The change in the redefinition of marriage is the same type of thing.”?

JACOBS: “This evidence is not just a smoking gun. It was an arsenal of incendiary devices directed at the LGBT community and voters. This is how the Prop 8 side won — through fear and lies.”
SAN FRANCISCO, CA — Rick Jacobs, Chair of the Courage Campaign Institute issued the following statement on the Prop 8 campaign videos and documents introduced into evidence this morning in the Perry v. Schwarzenegger trial. The new evidence shows how the Prop 8 campaign tried to link marriage equality to incest, bestiality, pedophilia and polygamy:
“This morning’s evidence made the Prop 8 side’s strategy crystal clear — use fear and lies to promote hate. It is horrifying that Prop 8 proponents would compare marriage equality to the 9/11 terrorist attacks and imply that marriage equality will open the door to pedophilia, incest and bestiality.”“Ron Prentice, Andrew Pugno and their Prop 8 team — with the highly capable and apparently deeply cynical leadership of Frank Schubert — created a permanent campaign to scare voters into believing that same-sex marriage would threaten children, undermine America and lead to every form of illicit behavior imaginable. ”
“This evidence is not just a smoking gun. It was an arsenal of incendiary devices directed at the LGBT community and voters. This is how the Prop 8 side won — through fear and lies.”
“Finally, this morning we saw indisputable, documented evidence in the form of emails and videos that Ron Prentice and Protect Marriage coordinated closely and relied upon the Catholic Church, the LDS Church, the Family Research Council, Maggie Gallagher, Brian Brown and the National Organization for Marriage to get Prop. 8 on the ballot and to win through a campaign of lies.”
“Last week, the Supreme Court erased decades of precedent by ruling that corporations have the same rights as people when it comes to speech. Let’s hope that the court will as readily see that LGBT people have at least the same rights as corporations and surely the same rights as other people.”
Via the Prop 8 Trial Tracker web site, the Courage Campaign Institute has brought the proceedings to the public in real time,, garnering more than 1.1 million views and helping fuel an online community of “Trial Trackers” posting more than 11,000 comments to date. UPDATE 2:More from AFAR’s Yusef Robb:
Quotes from Gary M. Segura, Ph.D., Professor of American Politics in the Department of Political Science at Stanford University.Dr. Segura was called by the plaintiffs to testify last week as an expert. Unlike defendant-intervenors’ witness Kenneth Miller, Dr. Segura’s expertise was unchallenged. Dr. Segura testified about the relative political power of gays and lesbians as a class of citizens, and their level of political vulnerability.
Below are excerpts from his testimony:
“Gays and lesbians do not possess a meaningful degree of political power.”
“They are not able to protect their basic interests and effectuate their interests into law and to secure those.”
“Relative to some other groups that currently enjoy judicial protection, gays and lesbians are actually, in the statutory and constitutional sense, worse off than some of those groups were when they were granted judicial protection.”
“They have essentially lost a hundred percent of the contests over same-sex marriage.”
“The initiative process has been really the Waterloo of gay and lesbian politics.”
“Initiatives have been used to roll back legislative gains by gays and lesbians over and over,” Segura testified.”There is no group in America….who’ve been targeted by ballot initiatives more than gays and lesbians.”
Segura noted that the gay and lesbian community has lost 33 of the 34 ballot measures across the country dealing with marriage.
(Note: the one “victory” was in Arizona, where the way it was drafted impacted health insurance. They changed the language the next year and it passed. So really, all have been lost -yr)

Nothing changes, nothing changes
These people make me sick! And was it just me or was there a quote earlier of the leaders of Prop 8 telling volunteers that if they ran into people who were going to vote no on 8, then they should use the children to “flip” them by telling them the kids would be taught how to be gay.
They prey on the ignorant and biased and those people who don’t have the means or awareness to know better.
Wait, you mean nailbiters can be discriminated against?Nasty habit: I demand that nailbiters be prohibited from getting married, and that it become legal to beat them up.
I’m extremely disappointed with these people. How could they miss blaming the Haitian earthquake on us? And eclipses? And swine flu, measles and hiccups? They’re obviously asleep at the switch.
As a nailbiter myself, TechBearI can honestly attest to the fact that we nailbiters are violent and militant too.
your Honor, the Plaintiffs now call Rick Santorum to the standMan on horse marriage, eh? Not possible, as there’s no such entity in the U.S. as a state secretariat.
the smoking gun has been online since nov 2008.
i’m just saying…
“I think a helpful way to think about this is to compare it to 9/11video
Is it just for me, or is there strong irony with these folks talking about polygamists? The LDS Church funded pro-8 campaign rolling out the idea that the “polygamists are just waiting in the wings.”
How did our side not call them out on that? Please, I’d love to hear Rachael Maddow take on the the LDS Prophet over this one.
I guess that would make me a bi…Between being discriminated against for being a nail-biter or a pillow-biter who has time to just be black anymore?!? snark!
In retrospect“Our side” was out to lunch.
I think what we should really wrap our brains is who these people are…This where phone calls sponsored by prop 8 for the leading evangelical pastors and leaders in this country. Publicizing some of this information once this trial is over should be a very high priority. In fact it would be nice to superimpose some of these statements over the polished and sanitized quotes of these people during the next referendum! See how that plays with the public.
Truth in Politics??It seems that the ongoing propaganda spouted by the homo/trans phobes is never anywhere near truth based. What we really need to push for is a “truth in advertising” type of law that would hold the person or group legally liable for the accuracy of their political propaganda.
We will never hear the truth if we do not hold them liable for their outrageous claims.
people have a right to lie in campaignsand it’s ‘buyer beware’ at the ballot box. this is the conclusion that the washington state supreme court has come to regarding lies and hyperbole in campaign ads. and really, who would be the arbiter of truth? the best thing to do is give a full expose and debunking of the lies of the other side, as is happening in this trial.
How far does the right to lie go in campaigns? Is libel against individuals legal in political campaigns, or only libel aimed at whole categories of people?
good question
Evil, evil peopleEvil. Cannot stress this enough. A perpetuation of decades of lies and fear, full-blown media attacks against the gay community. Child molesters, sociopaths, insane, GRID-bearing. Mobilization of millions of dollars, hundreds of churches, thousands of pastors. A full-on war of worlds.
I can’t believe these people, hiding in their darkness. Causing the suffering of hundreds of thousands of lgbt people the world over. More and more people hurting, every day, being bullied, being harassed, until soon they can’t take it, can’t take the stress anymore, their lives being ridiculed, their lives being dictated, their rights voted on. Soon they crack. One life lost. One voice silenced. One spark diminished.
Cannot express the righteous indignation that blazes up within me every time I visit the trial tracker after school and read the day’s proceedings. I cry at least once a day. I’m getting so, so sick of all of this.
I’d type more, with much more fire, but my l key was vacuumed up today (wtf). Been c/ping so far.
whew…when ya think they can’t suprise ya with a lower more despicable analogythey drag out a G*D DAMN Tijuana donkey act and 9/11…motherf*ckers
NG- Who are these lying dolts purposedly misleading people? The articles that I’ve read say unidentified people and don’t even mention good ole’ Miles. What a loving person he is……..he compared us to cockroaches (check out Good as You Blog yesterday for link to this). I think that we need to name names and expose these scumbags. They knew what they were saying wasn’t true. Here we were focused on Ricky Warren and Miles McPherson and Jim Garlow were bashing away at us. I always wondered how they escaped bad publicity and public pressure.
Oops……..purposely
OK, let’s see if I have this…They claim gay marriage is analogous to 9/11, which must make me–as a married gay person–analogous to a terrorist in their eyes. And, you know, we declared war on terrorists and did all sorts of things to people we only thought might be terrorists, so by analogy…
And yet they try to argue that their proposition and their lies are not motivated by animus??
Uh huh. Sure.
For the recordI wrote extensively about those Prop 8 webcasts. And also about Jack Hibbs, the pastor at Calvary Chapel Chino Hills and Frank Pastore.
I’m surprised those two weren’t called in; They were both outrageous too, especially Hibbs.
PolygamyThis makes me wonder…have any polygamists ever mounted any legal challenges to the marriage laws? It would be a little hard to believe that the answer to that is “no”. I would think it would be easier to get plural marriage passed than gay marriage
. It’s just a little far-fetched to believe that polygamists are waiting in the wings with baited breath for gay marriage to go through first. Those who practice polygamy for religious reasons are probably not going to side with us queers anyway; they are much more likely to oppose us. (I am in no way judging polyamory or polygamy; just trying to wrap my head around how the fundies can make the claim about “polygamous activists” that they do.)
A hate crime? The more testimony being entered into evidence about the out and out lying the opposites used to get their way, the more I am thinking this could easily be a trial for a hate crime.
Really, why can’t we have a “truth in advertising” law?
( silly girl, its because the politicians would have to ok it. Aint gonna happen for that reason)
Thanks for the info NG
Was this extension of the comparisonbrought up in the cross-examination? If not, it should have been.
