| Dear Friend of Marriage,
Earlier this afternoon, the DC City Council voted 11 to 2 in favor of same-sex marriage, sending the bill to Mayor Adrian Fenty who has promised to sign it. The media would have you believe this fight is over. Nothing could be further from the truth.
Working closely with Stand4Marriage DC, we are committed to protecting the rights of DC voters who are being disenfranchised by their own government. The arrogance shown by DC Councilmembers has been simply outrageous. Eleven of the Council's 13 members are determined to force same-sex marriage on the District, even if that means trampling the DC City Charter and depriving District residents of the right to vote. The DC Charter guarantees its citizens the right to put an initiative on the ballot for a District-wide vote, but earlier this month, the Board of Elections rejected a measure that would state: “Only marriage between a man and a woman is valid and recognized in the District of Columbia.” The proposed initiative simply restated current DC law on marriage. Still, the 2-member board found no difficulty ruling the initiative invalid as a violation of the Human Rights Act. It's time for Congress to step up and restore the rule of law in the District of Columbia. If the DC Government is going to trample the rights of their citizens, Congress must intervene, invalidating the same-sex marriage bill unless or until the Council agrees to respect the rights of DC voters to bring an initiative petition. If Congress refuses to block the same-sex marriage bill, the DC Council will simply continue to ignore the rights of DC voters. Congressional leadership would like nothing more than to have this issue go quietly away. It's up to you and me to force Congress to deal with the issue! Send your message to Congress today! And please forward this message to at least five friends right now. Send it all across the nation. Every member of Congress needs to hear from his or her own constituents that this is an urgent civil rights violation taking place in the District of Columbia that requires Congressional attention! |

This is grand. Congrats to DC. Marriage equality has now found its way below the Mason-Dixon line.
The Congressional GOP is always screaming about state’s rights, so it will be interesting to see how they ateempt to use the Congress to over-ride the legislative act of a local government. But I expect no less from them. Their lack of principle has been well-documented long before today.
As for NOM, it looks as if they missed the fourth grade lesson of representative democracy.

But, somehow, it becomes government usurpation of the people’s rights when the folks elected by the people pass laws that these bigots don’t agree with. And when the people pass laws they don’t agree with (as was the case with Washington’s Referendum 71,) it suddenly becomes a matter for the courts to decide. And when the courts issue ruling that they don’t agree with, it goes back to being something that the legislatures should handle.

Agreed……but I’m reasonably optimistic on this one. DC is famously liberal, the mayor is definitely going to sign this, and I honestly can’t see a Democratic congress going out of its way to squelch marriage equality in DC. That said, if the Knights Who Say NOM actually try to pull something, we do need to be ready. I’m not underestimating them, and you’re right that we need to be wary.
(I still am inordinately amused by the fact that their name is NOM. It’s almost enough to make me suspect that it was deliberate so that we could make jokes about it. Almost.)

the president supports states rights.i think he couldn’t politically get away with backing federal interference in what is a local matter on par with states rights. i think if congress wants to see a true firestorm (figuratively), they’ll interfere with this marriage bill. i think we should take a cue from Congress’s lack of interference with the earlier DC law allowing recognition of marriage conducted in other jurisdictions. also, in the budget passed sunday congress also withdrew prohibitions on DC funding for domestic partner benefits and some other measures that conservatives oppose. the signal seems to be “hands off DC”.
