Inane laws are still on the books in a lot of places, in North Carolina it says in our state constitution that one must believe in God to hold public office. No one pays attention to this nonsense, of course…except the fool in Asheville who believes the newly elected members of the city council, who is an open atheist, should step aside. Bonus horror: the man making the charge is the former head of the Asheville NAACP.
Opponents of Cecil Bothwell are seizing on that law to argue he should not be seated as a City Council member today, even though federal courts have ruled religious tests for public office are unlawful under the U.S. Constitution.
“I’m not saying that Cecil Bothwell is not a good man, but if he’s an atheist, he’s not eligible to serve in public office, according to the state constitution,” said H.K. Edgerton, a former Asheville NAACP president.
Article 6, section 8 of the state constitution says: “The following persons shall be disqualified for office: First, any person who shall deny the being of Almighty God.”
…Fliers mailed before the election criticized Bothwell over his atheism and his book, “The Prince of War,” which denounces evangelist and Montreat resident the Rev. Billy Graham for pushing what Bothwell says is a theocratic agenda.

Talk about making a fool of himself, lol!Maybe he got confused and thought the “C” in NAACP stood for Cristshun. Sometimes it’s good to just let these people keep talking. Something about petards and hoisting…
The Supreme Court…unanimously ruled that State Constitutions that require religious tests / beliefs for public office are in violation of the First and Fourteenth Amendments to the US Constitution. In, like, 1960. (Could be wrong on the date.)
It’s strange that they didn’t rule it in violation of the religious test clause, but… that’s still two times unconstitutional.
i believe that sectionof the NC constitution is violative on its face, of the US constitution. i would say i’m surprised it’s even in there, but, well, i’m not.
we had “blue laws” in va, up until the mid 70′s, until someone challenged them, and they were tossed out. not without a fight though.
None of which kept Bothwell from taking officeIt’s near the close of Religious Connection’s summary. Bothwell was sworn in Tuesday night. Nice!
Said it before, will say it again.True “Freedom of Religion” includes “Freedom FROM Religion”…
I can understand H.K.Edgerton’s misconceptionI mean, they banned Gay Marriage on religious grounds, didn’t they?
You are right: Torcaso v. Watkins, 1961From the Wikipedia article:
That same year, the Supreme Court also ruled that laws based in religion, but which serve a secular purpose, do not fall afoul of the First Amendment (McGowan v. Maryland.)
The Alabama state constitution forbade interracial marriage until 2000And it was a terrific fight to eliminate that. In 2004, a measure was proposed to strike the mandate of racially segregated education (Section 256
that measure failed and is still part of the state Constitution.
The Alabama constitution still prohibits “idiots and insane persons” and any person convicted of “living in adultery, sodomy, incest, rape, miscegenation, crime against nature, … or of any infamous crime or crime involving moral turpitude; also, any person who shall be convicted as a vagrant or tramp” from voting or holding public office (Section 182.)
The fact that none of this is enforceable is irrelevant: all of this still remains the supreme law of the state.
And the Freaky Thing Is…The former president of the Asheville NAACP has at least one, erm, unusual pastime, according to the Citizen-Times
Any guesses why he’s the ex-president?
Amen!

A Detriment…Being a biracial lesbian I am going out on a limb by writing that being Arican American is becoming a detriment in more ways than just race.
Seriously it’s an embarassment to my sensibilities and ripe fodder for bringing back the days when those of us who looked like other ethnicities would “pass” lest we be associated with Imbeciles.
The Last thing I want to read is an article about some fool from the NAACP in NC trying to force an obsolete law down my throat by insisting that a freely elected official believe in God.
It’s the same feeling that I get as a result of dimwitted “Negroes” who are against Gay and Lesbian marriage in Washington DC and Homophobic Ugandans.
And don’t get me started on those African American who are angry because most of Tiger Woods lovers and his wife are wife are white because if Tiger’s scandal involved sistahs we’d be crying racism over the endless coverage! An insaner group we are: Black Folk.
Besides Jamiee Grubbs (mistress #2) is NOT Caucasian. Helllooooo?! See: http://bit.ly/8FQMlN
My words are meant to inflame because someone has to call out this crap for the shyt that it is.
Where are the so called Black leaders in support of this atheist? Where is the black LGBT in Washington DC in support of gay marriage? Um don’t tell me otherwise because I mam in the “Belly of the Beast.” (DC)
I’ll tell u where these people are: Hiding with their collective tails between their legs! Good Grief it’s an embarrassment.

MMMMMMM… maybe a little racism?
From Article VI of the Federal Constitution:
It’s poverty/education.Some startling facts on the state of racial equality in the US:
* The mean SAT score of black American students is the lowest by race. As of 2002, black students trailed Latino students by over 40 points in spite of the fact that many of those students don’t come from English-speaking households. (Meaning their parents aren’t as able to help them with homework, etc, or English might be their second language.)
* Black students are more likely than others to have been victimized at school.
* When the US unemployment rate still wasn’t at 9%, the rate for black Americans had already hit 15% or 20% if you count people who have already given up looking for work.
* The US has an embarrassingly low ranking when it comes to inter-generational socio-economic mobility. These are families who have been trapped in poverty, in some cases, since antebellum times.
How did Obama put it on the campaign trail? ”So it’s not surprising then that they get bitter, they cling to guns or religion or antipathy to people who aren’t like them.”
